Coburn: Obama's border funding 'wrong approach'
Sen. Tom Coburn said Tuesday he opposes President Barack Obama's request for $3.7 billion in emergency funding to address the influx of unaccompanied minors across the southwest border.
"That's $60,000 per child we will spend, in emergency money," the Oklahoma Republican said on CNN's "Crossfire."
"That shows how incompetent [the government] is."
Coburn said providing additional resources for detention spaces and immigration attorneys to the minors is the "wrong approach."
"We can put them all on a first class seat to their homes, that's $8 million,' he added.

Want to understand today's liberalism take a look at the story of a shooter in a Pennsylvania hospital on July 25. Here is the headline from People Magazine:
"Armed Doctor Saved Lives in Hospital Shooting Near Philadelphia, Police Chief Says".
Had this been multiple persons shot, CNN would have spent hours if not days on the story. However, since the doctor returned fire and pretty much ended what could have been a disaster CNN buried the story, because it didn't fit their political view of guns. In fact, I though maybe it was a false alarm after hearing the breaking news then nothing until I saw the story on a local news outlet. For years we have been socially manipulated by this and other liberal television programs. The experiment announced by Facebook is only a drop in the ocean to the extreme liberal views and intense hate we have been bombarded with by liberal programming. We started paying the price for it when Obama was elected President and it is getting worse.
All extreme liberals who post here will only attack or dismiss this notion but the rest of you please step back and observe. Read the hate that follows, a direct result of liberal media influence.
I must admit that CNN was not my primary news source that day and I my have just missed the story so I retract my statement and apologize to CNN!
The laws overturned in recent years for Chicago were:
– Ban on all gun sales within city limits
– Ban on gun ranges in city limits
– Ban on private transfer of guns in city limits as a gift or private sale
– Ban on handgun ownership in city limits.
– Ban on concealed carry (sort of... they didn't have a concealed carry permit, but were forced to create one by a lawsuit... which is pretty much the same thing as overturning a ban)
While the court cases happened at different times, the changes that were all forced by those cases took effect around the end of 2013/beginning of 2014.
In 2010 you would have been correct. Chicago did have probably the most draconian gun laws in the nation. They dont' anymore though.
And no, Chicago doesn't have a list of the historic bill numbers for their ordinances that have been overturned online... but you can search wikipedia to get a description similar to what I posted above with gun laws in the city that have been overturned.

To ask for almost 4 billion dollars to house, feed, clothe and provide medical services for the tens of thousand illegals from Central America is a huge con and does absolutely nothing to solve the problem. Before long, Obama will ask for another 4 or 5 billion dollars for the next hundred thousand coming across. IF the requested money was used to control the borders with more BP personnel, more technology and more punishment for illegally entering the US, it would make some sense. The best way to handle the situation, is to withhold the millions of dollars we pay to these governments until a large portion of this money be used to provide their country's children with food, health care and enforce stricter laws against the gangs. We CAN NOT afford to add that many illegal immigrants to our welfare system that is already overloaded. If there is money to spend, help our veterans and seniors. They have actually done something for our country and deserve a helping hand. I's time that people will take a stand and speak out against this invasion of our country.

Here's the thing:
The LAW says that immigration is not allowed to stop these kids at the border due to their country of origin.
The LAW says that immigration needs to provide hearing for these kids to determine if they are legitimate political refugees.
The LAW says that if found to be political refugees, they must be allowed to stay.
This is CURRENT IMMIGRATION LAW. The president is supposed to enforce that. If he didn't, Boehner would actually HAVE grounds to sue him for not carrying out the laws congress has passed. He's not allowed to buy each a first class ticket home because CONGRESS HAS PREVENTED HIM FROM DOING SO.
The president can't change that... only congress can.

The LAW, Kurt, states that anyone trying to gain access to this country is subject to inspection and therefore subject to be found eligible to enter or be denied entry into the USA.
You are partially right in some comments that you state are LAW. The truth is that Obama can deport all these kids back. I have addressed the power that POTUS has on the subject in another reply to your comments.
To be short, and so other readers are aware of the misinformation you are posting, a refugee has the right to have his case heard, not the right to stay in country until we prove that he or she does not qualify. In other words, these so called refugees could be sent home and their case be assigned to an asylum officer and eventually decided.
Please, do some research before posting inaccuracies or if you don't want to spend the time to do the digging or don't know about the subject, please refrain from posting.
The William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008.
This law made permanent a recurring reauthorization that congress had passed since 2000 dealing with child trafficking. Part of that law deals with unaccompanied children arriving at the US border who are not natives of bordering countries. The law specifies that those children must be taken into the US, housed and cared for and must be provided a hearing to determine if they should be granted political asylum. If not the law directs the executive branch to follow standard deportation proceedings (as opposed to childrent stopped at the border from Mexico who are simply returned to Mexico).

Again, while you refuse to see the truth of it... there are laws in place that give the executive branch the ability to modify or disregard laws passed by congress. Essentially congress has given the president the ability to override CERTAIN laws in specific cases... such as not prosecuting court cases regarding laws the justice department doesn't feel like they can win or delaying taxes to ease the implementation.
They haven't given him the power to do that with this particular immigration law. He CANNOT "use his pen" to fix this because congress didn't give him the power to do that like they did with the implementation of the ACA. He's actually ENCOURAGING congress to pass a law allowing him to do just that... give him the authority to expedite deportations with unaccompanied minors when the executive brance feels like there isn't any worry about child trafficking. But congress has to ammend the law before he can do that. The ball is not in his court.

The IRS tax code gives the Treasury department the authority to delay and reduce taxes during the period they are being implemented to make transition easier for those being taxed. This is in section 7805(a) of the Internal Revenue Code.
That power was first enumerated by law in 1921 and has been strengthened many times since.
The reason Obama could delay Obamacare's mandate is that:
1) It was declared a tax.
2) Congress WAY BACK IN 1921 gave the president the ability to delay the implementation of taxes to "aid transition".
There are other instances where congress has given the executive branch power to "make law" or "ignore law". For example, congress has given many government agencies the ability to enact regulations... without congress setting what those regulations shall be. They also have given the justice department the ability to not try cases where the lawyers believe they are sure to lose. These are examples where CONGRESS has given the executive branch the power to make or ignore laws.
This is not a tax. Nor is there any other law on the books that gives him the power to administratively ignore pieces of this law. Thus congress has to act.

You keep contradicting yourself, either he can use his pen at will or not. Since, you are so proficient at law, provide a list of laws the president is allowed to change at will. Also, would it be OK for the next president to undo with their pen all Obama has done with his pen. After all, these would be the same laws obama was allow to change at will.
The mandate IS a tax.
That is what the supreme court said when they upheld the mandate for the ACA. They said that the penalty for not following the mandate is allowed due to congresses authority to tax. That means that the transitional authority the president has applies to that part of the law.
I'm sorry you aren't getting it... but let me try one more time for you.
The president has whatever authority the constitution and congress have given the president. Over the years, MANY laws have been passed that give the president limited authority to either enact his own law or disregard other laws. The reason he can do this is congress passed a law saying he could do it.
The reason the justice department doesn't have to try cases where they think they'll lose is congress passed a law giving them that power. The reason the FDA can determine what drugs they regulate and what the rules are is that congress passed a law giving them that power.
That doesnt' mean that the ATF can determine which guns are illegal... because congress has NOT given them the power to do that. The only cases where the executive branch can ignore or implement law is when congress has already passed another law specifically allowing them to do so.
The IRS tax code (passed by congress) already gives the executive branch the power to delay taxes under "transitional authority". That doesn't mean the president can ignore an immigration law because congress has NOT passed a law giving him that power.

I read the section Interim Assistance to Children in the William Wilberforce Trafficking Victims Act. You are right in pointing out that such assistance is available by law to children of TRAFFICKING.
In criminal law, there is a clear difference between Human Smuggling and Human Trafficking. These children and adults that are coming and presenting themselves to Border Patrol Agents, are victims (by their own choice) of Human Smuggling.
Human Trafficking is the act of establishing human trade for sexual slavery, forced labor, or commercial sexual exploitation.
By that definition alone, these children can not be afforded the protection of the stated Act.

While the law in general is about trafficking, the specific section governing the handling of unaccompanied minors is not in any way limited to those who are being trafficked.
The purpose of the mandatory hearing is to determine if they are a victim of human traficking or not. It's not that they don't get a hearing unless they are victims of trafficking. YOu have it backwards.
This isn't a criminal statute. It's a congressional directive to the executive branch about how to handle unaccompanied minors from other countries that arrive at the US border. It handles them based on two categories... those from contiguous countries and those from non-contiguous countries an specifies how they are handled based on which category they fall in. While it's part of a law dealing with trafficking of people, it's not just enacting a criminal statute. It is a wide ranging piece of legislation.
There are no "requirements" to be covered under this law other then the fact you arrived at the border as an unaccompanied minor. Those from contiguous countries are handled one way under the law, those from non-contiguous countries are handled another way. There is no other test... those come when the hearing occurs to determine if you can STAY.

So the Act that in its title has TRAFFICKING applies to people that are not victims of trafficking. That makes a lot of sense. I guess is how you interpret it huh? Just like the Constitution?!

So you mean to tell me that we are going to apply a section of an Act to a person that said Act was not enacted for? Seriously.
I don't know how much experience you have in the immigration field, or where you get your information as to the legal or administrative procedures. I really don't know where you get that a hearing is held to determine whether a person is deemed to be a victim of trafficking. That part indeed does happen, but it only takes place when the subject claims to have been a victim of trafficking or the circumstances surrounding their case warrant it to be viewed in such light.
Otherwise, the stipulations of the Act could be applied to anyone.
Kurt, you seem like an educated person who can make a good argument based on what you read and what you perceive to be correct an applicable. I must say that I don't know your credentials nor what walk of life you come from, but at every turn you try to defend how this administration is addressing the immigration problem and the handling of these minors. Even when at times, when through this article and others people have try to educate you on the facts of the issue we are discussing. All I can tell you, without going into major detail, is that I've been working in the immigration enforcement field for more than 12 years and that the input I give you is based on knowledge of the law, firsthand accounts as well as accounts from personnel that are involved in the field on daily basis.
At this point, I know I won't change your mind as it impossible to change another person's mind. All one can do is present enough facts for you to be well informed so you can "see the light" sort of speak.

Obama's plan is working to perfection. This man knows exactly what he's doing. Congress won't give him Immigration Reform so he's overwhelming the system with these children and using them for political gain. He has taken a clause enacted by Bush and ran with it. A clause that was in place for exceptional cases.
Obama knows how to play the game, and that is why he's calling it a "humanitarian crisis" instead of an immigration problem. He knows extremely well (even though he keeps on stating that the vast majority want immigration reform) that the American public doesn't want immigration reform, a.k.a amnesty. The American public is aware of what happened in 86 and we still have an illegal immigration problem today.
Obama knows well that asking for 2 billion or 4 or whatever amount won't work and no one will approve such amount because in the end these kids won't be sent home. He want's to hire more judges so the kids have their "due process". The enforcement and judicial side of immigration is a joke!
In the end Obama won't get the money he's asking for, and in return, he will blame the GOP for being heartless, bnot being compassionate and being less than human for not wanting to address "the need".
IMO, asking for money with the pretext of being a solution, is totally false. Lack of money was the reason cited for not wanting to house every illegal alien caught because, according to this administration, it was costing over $50 daily to keep an IA in a detention facility. So only illegal aliens with criminal convictions were to be deported. But now all of the sudden POTUS asks for almost 4 billion to expedite the "return" of these kids?!

That's not "Obama's plan" That's the LAW as passed by congress. The increase in people coming requires more money to carry out that law, but the fact remains that Congress passed it and the president is required to enforce it.
It's crazy how the GOP is trying to paint the president as "ignoring the law" when he's doing the exact opposite. He's carrying out the laws on the books unless he can find a constitutional basis for not doing so (where the primary law of the land overrides congressional law). He does that even with the stupid ones.
In cases where there's not enough money, he does prioritize enforcement... and he asks for more money like he's doing now. Not sure what you think he is supposed to be doing different.

If you believe the law should change... fine.
Go to your congressmen and tell them to get to work. The point is Obama can't change it by himself. Unlike other laws that are in areas where congress has granted the president some authority to act, this particular law doesn't give the president any leeway.
He has to let them in.
They have to go through a hearing process to determine if they get asylum.
If denied asylum, they have to go through standard deportation procedures rather then just putting them on a plane and forgetting about them.
The law doesn't give him any wiggle room. He can't fix it through executive action because of that.

Southerngent... that's what's happening. They are using the law as written and sending those who don't qualify for asylum home. The problem is there aren't enough courts to handle the hearings to meet the demand from the number of kids coming over.

The cost effective solution is for congress to pass a law that allows the executive branch to skip the hearings when they determine there is little chance of the kids being here due to child trafficking (that or just take the law off the books entirely). But the president can't make that law happen... only congress can.

Garry Mccarthy, the Chicago Police Superintendent was in charge of the Newark Police Department for a drastic reduction in violent crime and was doing the same in Chicago with the help of strict gun laws. He came in early in 2011.

Then in January of 2014 many of those gun laws were overturned by the courts.

Another factor I failed to mention is population. Is the decline in murder rate proportional to the decline in Chicago's population? Same holds true for Detroit.
As to population, Chicago's population is going up. It's about 25,000 higher then in 2010.
In 2013 it was still declining, so what changed? How much was annexed for tax gains? Btw, the Chicago articles said 23,000 not 25,000. Still stretching truth, huh!
